Important disclosure. AVALONPLUS is published by an independent software developer (Frank Gärtner). I am not a registered investment adviser, broker-dealer, or financial planner, and Trading Garden is not licensed as an investment firm under MiFID II or the Austrian WAG 2018.
AVALONPLUS publishes generic, non-personalized trading signals generated by a fixed mechanical rule set. The same signals are made available to every subscriber identically and do not take into account any individual subscriber's financial situation, objectives, risk tolerance, account size, or other holdings. They are not personalized investment advice. Under EU law, they do not constitute investment advice within the meaning of Article 4(1)(4) MiFID II or the Austrian WAG 2018, as no personal recommendation is given. To the extent the signals qualify as investment recommendations under Article 20 of the EU Market Abuse Regulation (MAR) and Commission Delegated Regulation (EU) 2016/958, the underlying methodology, parameters, assumptions, cost model, and historical performance are fully disclosed in the publicly available Methodology Report.
Conflict of interest disclosure. The author actively trades the published signals on his own account ("The Compounding Experiment"). He therefore holds, or may hold, long or short positions in the recommended financial instruments at any given time. This is disclosed by design.
The decision whether to act on a signal — and full responsibility for any resulting trade and loss — rests entirely with the subscriber. Trading futures involves substantial risk of loss; you can lose more than your initial margin. Backtested performance has inherent limitations: it is generated with the benefit of hindsight, does not represent actual trading, and is not necessarily indicative of future results. Live performance may differ materially from backtests. Trade only with capital you can afford to lose, and consult a qualified professional before making investment decisions.
5. Subscription Terms & Right of Withdrawal (EU Consumers)
The AVALONPLUS Android app is offered with a 30-day free trial. Continued use after the trial requires a paid subscription (monthly or yearly), which is processed exclusively through Google Play Billing. The subscription contract is therefore primarily governed by Google's payment and refund terms. Cancellation is possible at any time via Google Play and takes effect at the end of the current billing period.
Under the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG §11), EU consumers have a 14-day right of withdrawal for digital services. By starting to use the app and accessing the live signal service, the consumer expressly consents to the immediate commencement of the service and acknowledges that — pursuant to §18 (1) Z 11 FAGG — the right of withdrawal is forfeited once the digital service has been fully provided.

6. Online Dispute Resolution (ODR)
The European Commission provides an online dispute resolution platform pursuant to Regulation (EU) No 524/2013:
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
